Escada (UK) Limited and its affiliated companies (collectively, “ESCADA”, “we” or “our”) are committed to protecting and respecting your privacy. This privacy policy (this “Privacy Policy”) (together with our Terms and Conditions, Terms of Use and Cookie Policy) sets out the basis on which ESCADA collects, stores, uses, transfers, and discloses your personal information (as defined below).

This Privacy Policy applies to ESCADA website, mobile applications (if any) and the services we provide (collectively, the “Site”) [as well as the stores we own or operate in the United Kingdom, European Economic Area (“EEA”), and the United States.

THIRD PARTY SITES

This Site may link to or incorporate websites or content hosted and served by others over which we have no control, such as third party websites, online properties, platforms, social media, or systems, which are each governed by the privacy policy and business practices of the third party. You understand and agree that ESCADA is not responsible for the security, privacy, or business practices of any third party and such practices are not covered by this Privacy Policy.

As further detailed in the Terms and Conditions, we partner with Global-e, a third-party service that acts as your registered vendor, so you can buy and ship your ESCADA products to more than 200 destinations around the world. When you buy your ESCADA products through Global-e, you will see that your payment method is charged by ** Global-e / ESCADA **, and the purchase is subject to Global-e's Terms and Conditions and Privacy Policy, which will be clearly presented in the payment before placing the order.

INFORMATION WE COLLECT FROM YOU

This section explains, for different situations, what information we may collect directly from you (either on a voluntary basis or through automated means) and what information may be collected (or we may receive) from other sources. Some of this information may be considered "personal information" under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as your name, telephone number, and e-mail address), as well as additional information, including IP addresses and cookie identifiers, where required by applicable law. And, if we combine information that we consider to be non-personal with personal information, we will treat the combined information as personal information under this Privacy Policy. In the limited circumstances in which we may process sensitive personal information as defined by applicable law, we process such information as permitted by and in compliance with applicable law. Note that we may de-identify personal information so that it is non-personal, such as by aggregating it or transforming it into information that does not identify you. We will treat de-identified information as non-personal to the fullest extent permitted by applicable law.

Where collection is mandatory, we may not be able to provide you with the product or service you requested if you choose not to provide that information to us (e.g., name and delivery address for the delivery of a product).

Please note that our products and services are not directed to children under the age of eighteen and we do not knowingly collect information from children under the age of eighteen. If we become aware that we have inadvertently received personal information from a customer under the age of sixteen, we will delete the information from our records.

We process the following categories of your personal data when it is necessary for the performance of a contract between you and us:

  • your name (and that of a delivery recipient, if different and applicable)
  • email address
  • delivery and billing address
  • telephone number
  • payment card details, and
  • site login details.

We will also process the following categories of data for the purposes of our legitimate interests:

  • fraud screening and prevention purposes; and/or
  • for record keeping purposes.

We process the following categories of data for marketing purposes if we have a legitimate interest or when you give us your consent:

  • email address and name; date of birth; preferred gender or pronouns
  • how you have reached our digital platform and the internet protocol (IP) address you have used;
  • your login information;
  • browser type and version;
  • plug-in, operating system and platform;
  • the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time);
  • products you viewed or searched for;

  • download errors;
  • length of visits to certain pages;
  • page interaction information (such as scrolling, clicks, and mouse-overs);
  • methods used to browse away from the page; and
  • any phone number used to call customer service.

When you participate in surveys, competitions, events or promotions, we may collect your contact information including name, e-mail address and country of residence, mobile number, as well as your gender or birth date. We may also collect any personal information submitted or received through customer surveys, competitions and events such as your feedback, responses, shopping preferences or image.

If you visit our stores, in addition to information you may provide voluntarily, such as payment information, name and email address if you choose to join a customer registry, and other personal information processed in the same manner as when you interact with the Site, we may also collect:

  • your image on CCTV which our stores use for the prevention and detection of crime and for protecting the safety of our customers and for traffic counting;
  • depending on the selected payment method, a copy of documents you provide to prove your age or identity where required by law, which may provide details of your full name, address, date and place of birth, gender and nationality;
  • your name and email if you choose to utilize complimentary Wi-Fi where offered; and
  • information about your device (including MAC address, connection date, time and location) through sensors (only if your Wi-Fi is turned on) for store analytics. If you want to disable this functionality, please turn off Wi-Fi in your device settings.

We may collect some of your information using automatic data collection technologies as you navigate through and interact with the Site. This may include certain information about your equipment, browsing actions and patterns, including:

  • IP address;
  • login information;
  • browser type and version;
  • time zone setting;
  • location;
  • operating system and platform;
  • products viewed, searched for or purchased;
  • page response times;
  • download errors;
  • length of visit to certain pages;
  • page interaction (scrolling, clicks, mouse-overs); and

In common with many other website and app operators, we use standard technology called 'cookies' on our website. HOW WE SHARE YOUR INFORMATION

Within ESCADA and with our Affiliates: We may share your personal information within ESCADA and with our Affiliates, which may include entities in the United States. For the purposes of this Privacy Policy, “Affiliates” means entities directly or indirectly controlled by or under common control with us. If you interact with our Affiliates directly, the privacy policy and practices of that company will govern.

With our third-party service providers: As a global organization, ESCADA relies on third-party service providers to perform a number of business transactions on its behalf. We use third parties to perform certain services on our behalf, such as hosting the Site or Site features, providing website usage analytics, fulfilling orders, processing payments, sending email or other communications, providing marketing assistance and data analysis or enhancement, running Promotions, or performing other administrative services. We may share information about you with these third parties to allow them to execute, deliver, or improve the services that they provide for you and for ESCADA.

With our business partners who have been carefully selected: ESCADA often collaborates with business partners that it has carefully selected to offer joint promotions or products that may be of interest to you. To the extent permitted by applicable law, we will collect information about you with our business partners for the purpose of sending you promotional communications. For these programs, we will explicitly tell you when we collect your personal data that your information will be shared with our business partners that we have carefully selected and you will seek your permission to do so, in accordance with applicable law.

Advertising Partners and Promotions

We work with companies who provide advertising and marketing services for ESCADA or the Site. These companies may collect personal information from you when you use the Site. In the event that you participate in a survey, sweepstakes, contest, or other promotion that is sponsored by ESCADA and/or a third party, such participation serves as your consent for ESCADA to share your information collected in conjunction with the survey, sweepstakes, contest, or promotion, with that third party. After the information is provided to such third parties, the subsequent use or disclosure of such information is subject to those third parties' privacy policies and practices.


Other situations in which your information can be shared

We may disclose your personal information if we believe it is necessary to protect and defend the rights and property of ESCADA, including for the purpose of enforcing our terms and conditions, or where the law and / or government authorities require. This disclosure may include legal requests from a jurisdiction outside of the UK when we have a good faith belief that the response is required by law, regulation, court order, or other legal request or process in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally-recognized standards.

We may share aggregated or anonymous information that does not identify you for ESCADA business purposes. For example, we may disclose the number of visitors to our websites. We may also share with our business partners aggregated or anonymous information that does not identify you for the commercial purposes of our business partners, in accordance with applicable law.

We may disclose or transfer your information in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, or any other transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets to another company.


Content created by users

Some ESCADA sites allow users to publish their own content or to participate in blogs, etc. Any information you submit or post as user-generated content on ESCADA' websites will become publicly available information. We recommend that you exercise caution when deciding to make certain information public in these postings or posts. ESCADA cannot prevent others from using this information in a manner that may violate this Privacy Policy, the law or your privacy or personal safety. As further set forth in the Terms of Use, ESCADA is not responsible for the consequences of this type of publication.


HOW WE PROTECT YOUR PERSONAL INFORMATION

Transfer of information: As a global organization, your information may be transferred within the ESCADA organization located in a country that may be different from the one in which you live, or to our trusted third parties based in other countries so that they may process your information on our behalf. This may include the transfer of your information to the United States, which may not ensure an adequate level of data protection. In this event, we will implement appropriate safeguards to ensure an adequate level of data protection. In such instances, we comply with applicable legal requirements providing adequate safeguards for the transfer of personal information to countries outside of the EEA, the United Kingdom or Switzerland by concluding data transfer agreements based on the European Commission’s Standard Contractual Clauses or selecting U.S. service providers that are certified to the Data Privacy Frameworks. By using this website or providing information to ESCADA, you authorize us to transfer your information in accordance with the terms of this Privacy Policy and the applicable data protection law.

Information Security: ESCADA maintains appropriate administrative, technical and physical safeguards to protect the personal information you provide on this website against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use and other unlawful forms of processing. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure and you use the Site and transmit information to us at your own risk. HOW LONG DO WE RETAIN YOUR PERSONAL INFORMATION?

We keep the personal information we collect for the duration of our relationship with you, plus a reasonable period in order to take into account the applicable legal retention requirement or statute of limitation period, or otherwise as required for our business purposes described in this Privacy Policy.

If you consent to receive marketing communications, we will keep the information necessary to send you these communications for a period of eight (8) years following the end of our customer relationship or following their collection, if you are a prospective customer.

At the end of the retention period, your personal information will be deleted completely or anonymised so that it can be used in a non-identifiable way for statistic and analytical purposes.


YOUR RIGHTS

You are free to withdraw your consent and opt out of receiving marketing emails from ESCADA by following the one click instructions in any marketing email you receive, or by logging into your online account and adjusting your preferences in your account management preferences settings.

Please note that if you do opt out, it may take a few days to process your request and that you may continue to receive promotional or marketing materials during this time. Opting out will not preclude us from sending you other types of non-promotional messages, such as emails confirming transactions or abandoned basket emails.

Under certain circumstances, you have the right by law to:

  • request access to your personal data that we hold;
  • request correction of the personal data we hold about you if it is incorrect, out of date or incomplete;
  • request erasure of your personal data, for example where the information is no longer necessary for the purpose which it was collected for, or you withdraw your consent for us to hold such information;
  • object to processing of your personal data;
  • request the restriction of processing of your personal data, for example where you suspect the information held is inaccurate, or is being used in an unlawful manner but you do not want it to be erased (i.e. if required for establishment or defence of a legal claim);

Please note that where you subsequently object to our processing, or otherwise request that your data is erased, we will be required to retain some of your personal data until we have delivered your ordered goods or performed your requested services, unless you inform us you wish to cancel your order.

When exercising any of the rights listed above, we will ask you to verify your identity before proceeding to ensure that your personal data is adequately protected from unauthorised use. Likewise, if you have authorised a third party to submit a request on your behalf, we will ask them to prove they have your permission to act.

If you are based outside the UK, you have the right to lodge your complaint with the relevant data protection regulator in your country of residence.


IF YOU ARE UNDER 18

The site is not directed to individuals under the age of 18. If you are under the age of 18, please stop using the Site. It is our policy not to knowingly solicit or permit anyone under the age of 18 to provide their personal information for any purpose.
